Privacy Policy

We process personal data on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016) (the “Regulation”). On the basis of this Regulation, Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments and Additions to Certain Acts was adopted in Slovakia

As a data subject, you have the right to know how we process your personal data. Personal data is any information by which a specific natural person can be identified, directly or indirectly. “Directly” means, for example, by means of clear identifiers such as a birth number, name or address; “indirectly” means by means of a combination of other information.

What personal data do we process?
The personal data we process includes, but is not limited to:

  • first and last name,
  • Title,
  • Signature,
  • Gender,
  • address of residence,
  • email address,
  • phone number,
  • bank connection,
  • date of birth or birth number,
  • data from identity documents.

The set of personal data processed varies depending on the personal data information system, others are processed by the HR department, others by the CCTV system, etc.

In the case of job applicants, this may also include information on education, other information provided in the job application, CV, motivation letter and its annexes.

How do we collect personal data?
We obtain personal data directly from you, however, there are cases where we may receive your personal data from other entities based on legislation, contracts or your consent. In particular, the sources of this personal data for us are:

  • your employers,
  • The Ministry of the Interior of the Slovak Republic, which administers the relevant registers, in particular the population register,
  • Financial Administration of the Slovak Republic,
  • Social Insurance Office,
  • health insurance companies,
  • Ministry of Labour, Social Affairs and Family of the Slovak Republic,
  • trade offices,
  • Prison and Judicial Guard Corps,
  • Register of legal entities,
  • Business Journal,
  • publicly available registers,
  • law enforcement authorities,
  •  

On what legal basis do we process personal data?

  • the processing of which we are required to process by special regulations (in particular the Labour Code, the Health Insurance Act, the Accountancy Act, the Social Insurance Act, tax regulations) or an international treaty; or
  • the processing of personal data is necessary for the performance of a contract to which the data subject is a party or for the performance of a pre-contractual measure at the request of the data subject; or
  • the processing of personal data is necessary to protect the life, health or property of the data subject or another natural person; or
  • the processing of personal data is necessary for the purpose of the legitimate interests of the controller or of a third party, except where those interests are overridden by the interests or rights of the data subject requiring the protection of personal data, in particular where the data subject is a child; or
  • if the data subject has consented to the processing of his or her personal data for at least a specific purpose.

    As the operator of the website, we do not collect personal data that could identify a specific person, except where the person themselves voluntarily provides us with this data. Such data may be collected when you voluntarily register to use our website services. Any personal information identifying a specific person will not be provided or sold to a third party, except when the user is notified at the time of data collection. As the operator of the website, we reserve the right to conduct analyses of user behavior on our website. These analyses include, for example, measuring traffic and tracking user behaviour on the website. This data may be made available to potential advertisers, but always in the form of a statistical overview, not by name. As a website user, by using our website, you acknowledge and agree that the data you voluntarily provide to discussion forums or other automatically generated pages may be used by a third party. Such use of information/data cannot be controlled and we are not responsible for it. By using our website, you acknowledge that some information about you may be automatically collected in the course of standard server operations (e.g., the user’s IP address) and also when using cookies (small text files that are stored on the user’s computer for the purpose of identifying or authenticating the user, or for the operation of e-commerce). Cookies are not programs that could cause damage to the user’s computer.
    We reserve the right to withdraw the guarantee of safe handling of your personal data in the event of an attack on the server by an unknown perpetrator (hacker). In this case, the above data handling rules do not apply.

Only if the purpose of the information system requires it (HR, accounting, CCTV…), they can be recipients of personal data:

Do we transfer your personal data to third countries (outside the EU)?
We do not transfer personal data to third countries outside the European Union (EU) and the European Economic Area (EEA).

How long do we process your personal data?
We process personal data in accordance with our registry plan for as long as we are required to do so by specific laws.

If you give us consent, we process it for as long as stated in the consent given, if not stated, we process it for as long as necessary for the purpose for which the personal data is processed. If we have a contract with you, we process it for as long as the contract lasts, or longer if we are pursuing legal claims under the contract, for example through the courts.

Do we carry out automated individual decision-making and profiling?

We do not.

 

What are your rights as a data subject?

Right to withdraw consent

In cases where the processing of personal data is based on your consent, you may withdraw this consent at any time.

Withdrawal of consent does not affect the lawfulness of the processing of personal data on the basis of your consent prior to its withdrawal. In some cases, withdrawal of consent may result in the inability to use certain services that are based on the processing of your personal data.

Right of access to personal data

You have the right to ask us to confirm whether we are processing any of your personal data, including, for example, information about which categories of personal data we are processing, for what purpose the personal data is being used, to whom we are transferring it, how long we will keep it, where we obtained it – if not directly from you – or to which recipients or categories of recipients we have disclosed the personal data, or about your rights in relation to it.

We are also obliged to provide you with the personal data we process about you if you request it. For reasons of data protection and security, we provide personal data by sending it by registered mail in our own hands or by handing it over to you in person at our registered office, where, depending on the scope, your personal data will be handed over to you against your signature, after verification of your identity, preferably on a data carrier.

We reserve the right to charge a reasonable fee for repeated requests to provide the personal data we process that you request. The fee will be charged in the amount of the administrative costs associated with making copies of the data (e.g. the cost of the data carrier – CD, USB key).

Right to rectification of personal data

If you suspect that your data processed by us is incorrect, you have the right to ask us to correct or complete your personal data.

Right to erasure of personal data

We will delete your personal data without undue delay if:

  1. the personal data is no longer necessary for the purpose for which it was collected or processed;
  2. the processing is based on your consent, you withdraw your consent and there is no other legal basis for the processing;
  3. you object to the processing of your personal data for the purposes of our legitimate interests and there are no legitimate interests of ours overriding yours at the same time;
  4. personal data have been unlawfully processed;
  5. their deletion is required to comply with a legal obligation imposed by European Union or Member State law to which we are subject;
  6. the personal data collected concerned a person under the age of 16;

 

Right to restriction of processing of personal data

We may restrict the processing of your data if:

  1. you question the accuracy of the personal data for as long as we need to verify its accuracy;
  2. the processing of personal data is unlawful and you request a restriction of processing instead of erasure of the personal data;
  3. we no longer need the personal data but you require it to establish, exercise or defend your legal claims; or
  4. you object to the processing while we verify the validity of your request.

Right to portability

At your request, we will transfer all personal data processed to you in a structured, commonly used and machine-readable format or, if technically feasible, to another controller identified by you. This right can be exercised provided that we process your personal data on the basis of your consent or a contract and only if the processing is carried out by automated means. Please note that the exercise of the right to data portability does not affect personal data that we process on the basis of law, for example for the purposes of public health insurance.

Right to object to the processing of personal data

You may object to the processing of your personal data at any time for a specific reason, provided that the processing is not based on your consent but on our legitimate interests or the legitimate interests of a third party. In this case, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds outweighing your rights and freedoms. If you object to processing, please indicate whether you wish to erase your personal data or restrict processing.

Right to lodge a complaint

In the event of an alleged violation of applicable data protection laws, you may file a complaint with the data protection supervisory authority in the country in which you live or in the country where the alleged data breach occurred. In Slovakia, this authority is the Office for Personal Data Protection of the Slovak Republic.

Time limit for processing your request when exercising your rights

We will always try to process your request within 30 days of receipt. However, the time limit may be extended by a further 2 months due to complexity. We will inform you of this within 30 days of receipt of your request at the latest, together with the reason for the extension. You are also entitled to lodge a complaint with the supervisory authority in this case.

Restrictions on the processing of your request

In certain situations, we may not be able to disclose some or all of your personal data to you, in particular because of specific legal provisions or to protect the rights and freedoms of third parties (e.g. if there is data of other persons in the same document). If we refuse your request for access, we will also tell you the reason for the refusal.

Impossible to identify

We anticipate that in some cases it may not be possible to trace all of your personal data to the identifiers you have provided in your request. In such cases, where we are unable to identify you as the data subject, we are unable to comply with your request unless you provide us with additional information enabling us to identify you.

We also have the right to ask you to verify your identity if we have any doubts about your identity. We will inform you of the reasons why we are unable to process your request.
